PRESS RELEASE
The Surgical Manufacturers and Traders Association has approached the Hon’ble High Court of Delhi on 14.12.2020 preferring Writ Petition (Civil) No. 10478 of 2020, titled, “Surgical Manufacturers And Traders Association Vs. Union Of India” impugning the Notification bearing S.O. No. 648 (E) dated 11.02.2020 passed by the Ministry of Health and Family Welfare, Union of India, whereby all devices intended to be used specially for human beings or animals have been declared as drugs, as defined under Section 3(b)(iv) of the Drugs and Cosmetics Act, 1940.
The Association has previously also filed Writ Petition (Civil) No. 10514 of 2019, titled “The Surgical Manufacturers & Traders Association Through Its Authorised Representative vs Union of India” challenging an earlier Notification bearing No. 4754 dated 03.12.2018, notifying some medical devices namely the Digital Thermometer, Nebulizer, Blood Pressure Monitoring Device and Glucometer as drugs. The same is also pending before the Hon’ble High Court of Delhi.

Plea against all medical devices by The Surgical Manufacturers and Traders Association
New Delhi, Dec 16 (PTI) The Delhi High Court on Wednesday sought response of the Centre on a plea challenging its decision to notify all devices, like blood monitoring devices and digital thermometers, intended to be used specially for human beings or animals as drugs.
A bench of Chief Justice D N Patel and Justice Prateek Jalan issued notice to the Health Ministry and sought its stand on the petition by the Surgical Manufacturers and Traders Association (SMTA).
The plea claimed that the representations of SMTA and other stakeholders were not considered at the time of taking the decision.
The court listed the matter for hearing with a petition moved last year by SMTA challenging a notification which declared blood monitoring devices, digital thermometers, nebulizers and glucometers as ”drugs” under the Drugs and Cosmetics Act.
The bench said both the matters will be heard on January 29, 2021.
SMTA, represented by advocate Adit S Pujari, has contended that the notification is unreasonable, arbitrary, and would cause “undue hardship to stakeholders on the supply and demand side”.
In its earlier plea, the association has said that notifying the devices as drugs will result in a substantial hike in their prices which would make them unaffordable for a large segment of society. PTI HMP RKS RKS
