Sub: Monitoring of Maximum Retail Prices of (i) Pulse Oximeter and (ii) Oxygen Concentrator under DPCO, 2013-reg.
This is in reference to Notification No. 1232 (E) dated 31st March 2020 issued by this Office for regulation of Medical Devices under Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955 w.e.f. 1st April 2020. Accordingly, Maximum Retail Price of Medical Devices cannot be increased more than ten percent (10%) in a year.
2. All the manufacturers/importers of (i) Pulse Oximeter and (ii) Oxygen Concentrators are hereby directed under Para 29 of the DPCO, 2013 to submit the MRP details in the prescribed format (Annexure-I & II) within 7 days i.e. latest by 22nd May 2021 of issue of this O.M. A soft copy of the same may be sent to the following e-mail id mandatorily: medicaldevices-nppa@gov.in 3. In view of the above, all Manufacturers/Importers of aforesaid Medical Devices are hereby advised to ensure compliance of the provisions of Para 20 of the DPCO, 2013 failing which action may be initiated for violation of provisions of DPCO, 2013 read with Essential Commodities Act, 1955.

News channels have been reporting sale of under rated oxygen machines

Dear Members,
News channels have been reporting sale of under rated oxygen machines which are selling in guise of oxygen concentrators for the last few days in the market. These machines are basically not designed to be used as Medical Devices and their application have merely limited use.
It is an unfair practice to promote and sell these machines as emergency medical devices and extort huge amounts of money against their sale from a needy person which are proving to be a death trap instead.
Such horrendous activities by these operators only worsens our trade environment and because of such activities that our trade is getting attracted to unnecessary stringent laws and licencing like the one which we are currently fighting for.
As a suggestion, any importer or a Stockist, who is selling genuine Oxygen Concentrators should be able to produce genuine technical product information, along with Purchase bills/ Sales bills incase of any checking by government officials. Additionally, MRP stickers/ labels on the product should be clearly visible and NO sale should exceed the MRP whatsoever.
SMTA has always been an Association of human friendly businessmen, let’s all get together and fight this difficult times by offering quality products at affordable prices and try to curb blackmarketing and sale of fake equipment.
The best thing to do is by offering the right product to the end user at a reasonable price.

Extension in filing of GSTR 3B and relaxation in delay payment
Extension in filing of GSTR 3B and relaxation in delay payment for period of March & April 21
(1) Taxpayers having an aggregate turnover of more than rupees 5 crores in the preceding financial year (for the month of March & April 2021)
- Interest rate to be levied – 9 per cent for the first 15 days from the due date and 18 per cent thereafter.
- Late fee not applicable for first 15 days for non-filing of GSTR 3B.
(2) Taxpayers having an aggregate turnover less than rupees 5 crores in the preceding financial year (for the month of March & April 2021 & quarter ending March ’21)
- Nil for the first 15 days from the due date, 9 per cent for the next 15 days, and 18 per cent thereafter.
- Late fee not applicable for first 30 days from the due date of furnishing return, for non-filing of GSTR 3B.
(3) Due date for furnishing GSTR -1 for month of April,2021 extended to 26th May,2021.
(4) Section 36(4) to be seen cumulatively for March’21 to May’21 in the return for the month of May 2021.
(5) Due date for furnishing IFF for the month of April extended to 28th May,
(6) For TDS deposit u/s 194-IA, 194-IB & 194M extended from 30.4.21 to 31.5.21.
(7) For filing Belated/Revised ITR for AY 20-21 till 31.5.21.

Black market is springing up once again amid the pandemic

Dear Member,
An informal message has been received from the Delhi government that the black market is springing up once again amid the pandemic for medical equipment and consumables which are essential to deal with Covid. Products such as protective gears, gloves, pulse oximeters, oxygen cylinders, flow enter, concentrators, masks, sanitisers etc are selling at very high price levels, and in few cases over the MRP.
The officer warned strict action against any one caught & the dealer would be booked under the provisions of the Essential Commodities Act.
My humble request to one and all, The SMTA carries the pride of being selfless businessmen in the industry and has always been a leader in good deeds, we should remain ahead of all in times of need by the nation .

Vaccine For All Above 18 Starting May 1
New Delhi: Vaccinations will be opened to all above 18 from May 1, the government on Tuesday announced after Prime Minister Narendra Modi held a series of meetings over India’s response to record daily surges in Covid cases.
All adults can get Covid shots and states can buy doses directly from vaccine-makers in the “liberalised and accelerated Phase 3 strategy of COVID-19 vaccination”, the government said, on a day the country reported 2.73 lakh new daily cases in the highest spike since the pandemic broke out a year ago.
India began inoculating people in January using two Covid vaccines – Serum Institute of India’s Covishield developed by Oxford-AstraZeneca and Bharat Biotech’s made-in-India Covaxin. So far, the government had allowed vaccinations only for health workers, frontline workers and those above 45 in a centrally-controlled process.
In his meetings yesterday, PM Modi stressed that vaccination was “the biggest weapon” in the fight against the coronavirus and urged doctors to encourage more and more patients to get vaccinated.
“The government has been working hard for over a year to ensure that maximum numbers of Indians are able to get the vaccine in the shortest possible of time,” said the PM.
Pricing, procurement, eligibility and administering of vaccines will be flexible in the latest round of the world’s largest vaccination drive.
Vaccine manufacturers have been incentivized to scale up their production and release up to 50 per cent of their supply to states and in the open market at a declared price.
States can now get additional vaccine doses directly from the manufacturers.
Here are some important new rules:
- Vaccine manufacturers will supply 50 per cent of their monthly Central Drugs Laboratory (CDL) released doses to the central government and will be free to supply the remaining doses to state governments and in the open market.
- Manufacturers will declare prices in advance for the vaccines supplied to state governments and in open market.
- Based on this price, state governments, private hospitals, industrial establishments can buy vaccine doses from the manufacturers.
- Vaccinations at central government centres, provided free of cost, will continue for those eligible currently – health workers, frontline workers and those above 45.
- The centre will allocate vaccines from its share to states or union territories based on the number of cases. Vaccine wastage can affect the quota of a state.
- The second dose for those eligible currently will be priority.
In recent weeks, states like Maharashtra, Delhi and Punjab had called for opening up vaccinations and had also complained about running out of vaccine stocks. But in a comment that became controversial in the state versus centre tussle, a senior official said: “The aim is never to vaccinate whoever wants it, but always whoever needs it.”
