Non-Filers of GST returns cannot generate E-Way Bill from 21st June: CBIC
The Central Board of Indirect Taxes and Customs (CBIC) has notified that the persons who failed to file the GST returns properly will not be able to generate the E-way Bills from 21st June 2019.
The notification issued by the Board last day clarified that the restrictions imposed by Rule 138E i.e. restriction on furnishing of information in PART A of FORM GST EWB-01 as inserted vide notification 74/2018-CTR have been made effective w.e.f. 21.06.2019.
As per the said Rule, no E-way bills facility shall be available for a registered person who has not furnished his GST returns for the last two tax periods. The Jurisdictional Commissioner may allow or reject the E-way bill filing facility upon request of such registered person. However, in case any contradictory decision is provided by the Commissioner of State tax / Union territory tax, then such decision shall supersede the decision of Jurisdictional Commissioner.
Under the GST regime, persons having a turnover of Rupees Forty lakhs should be registered with the tax department and file returns regularly under the statute. The new tax regime also introduced a mechanism where the consignment of goods valuing more than rupees fifty thousand would not be possible without a valid E-Way Bill.

1. Auto calculation of route distance based on PIN code for generation of EWB Now, E-waybill system is being enabled to auto calculate the route distance for movement of goods, based on the Postal PIN codes of source and destination locations. That is, the e-waybill system will calculate and display the actual distance between the supplier and recipient addresses. User is allowed to enter the actual distance as per his movement of goods. However, it will be limited to 10% more than the displayed distance for entry. That is, if the system has displayed the distance between Place A and B, based on the PIN codes, as 655 KMs, then the user can enter the actual distance up to 720KMs (655KMs + 65KMs). In case, the source PIN and destination PIN are same, the user can enter up to a maximum of 100KMs only. If the PIN entered is incorrect, the system would alert the user as INVALID PIN CODE. However, he can continue entering the distance. Further, these e-waybills having INVALID PIN codes are flagged for review by the department.

MCA Update
Companies Amendment Ordinance approved by the cabinet
The Ordinance has been approved today and SENT for Presidential Assent
The Ordinance has been promulgated based on the Report of Committee Constituted to Review Offences and suggested Corporate Governance Reforms.
As per my (CS Gurminder Dhami) of the aforesaid report, I have compiled below the list of key amendments (SECTION WISE) which are to come through the Ordinance:
- Decriminalization of over 80 offences.
- Tightening Disclosure of Beneficial Interest.
- Simplying penalties for minor offences (moving towards adjudication from prosecution). System of e-adjudication wherein ROC shall send online show cause notice, if not replied by company /director physical shall automatically be sent to the company, submission of reply online and posting of order online by ROC. Appeals to lie with RD.
Section 2(41) – Change in Financial Year to be done by CG (to be delegated to RD).
Section 11 – Re-introducing the Requirements of Obtaining Certificate of Commencement of Business. Non-obtaining of the same to be a ground of Striking Off.
Section 12 – Non Maintenance of Registered Office to be a ground for striking off of the Company.
Section 14 – Conversion of Public Co to Private to be with Central Govt. who can delegate it to ROC/RD & in case of bigger companies to NCLT.
Section 73 to 76 & Deposit Rules – An e-form to be introduced for reporting transactions which are exempted deposits.
Section 77, 78 & 87 – Maximum time period for registration/modification of charges to be 30 days + additional 30 days. Further condonation to be done in 60 days. After total of 120 days Charge Cannot be Registered.
Section 149 – Stricter norms for IDs & capping of their sitting fee & remuneration.
Section 164, 165 & 167 – Breach in Maximum no of Directorships to be a Ground for Disqualification.
Section 248 – Non-obtaining of Certificate of Commencement of Business and Non maintenance of Registered Office to be a Ground for Striking off by ROC.
Section 441 – Compounding
Compounding Threshold for going to NCLT to be revised to 25 lakhs from 5 lakh.
Prior permission of Special Court not required for Compounding of offences punishable with imprisonment or fine or with both by NCLT. Minimum Compounding fee shall be as minimum fine mentioned in the section.

Minimum Wages Notification
The Minimum Wages notified yesterday is not as per spirit of order. The court has not up-held the notification dated 03.0317 but as an interim arrangement directed Employers to pay wages as per this not fo3 months whereas the Delhi Govt has uploaded wages with 3 DA rise.
We all employers shall make payment of wages strictly as per Notification dated 03.03.17 and not as per notified yesterday. We shall also move an application with SC apprising latest facts. The wages are to be paid for Nov/Dec/Jan 19.
